確定的ＳＧ措置の内容

３年プラス１日間の数量制限措置。毎年６％を限度とした輸入量増加。１年目の輸入量は、１９９３年から１９９５年の３年間の輸入量を基準とした57,521,000キロに設定。同期間の平均輸入シェアを基準として、国ごとの割当を決定。

カナダなどいくつかの国は、数量制限措置の適用対象外とされた。

小麦グルテンについて

小麦粉から生産される。生産された小麦グルテンの８０％は製粉業者または製パン業者に送られ、残りはペットフード業者などに使用される。生産過程で生じる副産物は、エタノールなどの原料となる。

パネル決定の分析

１．先決問題

審査基準

　パネルは、ＤＳＵ（紛争解決了解）１１条に基づく適切な審査基準について、新たなデータを収集したり、当局に実際に提出されていなかった証拠を考慮したりするのは望ましくなく、パネルの役割は米国の措置がＳＧ協定及び１９９４年のＧＡＴＴ１、１９条に違反するか否かを審査することに限られる、と述べた。

秘密の情報

　パネルは、公開版ＩＴＣ報告から削除されている秘密情報について、客観的な評価に資するとして、秘密情報保護のための手続を採択した上で、ＩＴＣにこれの提出を求めた。しかし、ＩＴＣは手続の不十分さを主張し、結局要請された秘密情報を提出しなかった。

　パネルは、ＳＧ協定３．２条の加盟国調査当局の守秘義務と、ＤＳＵ１３条の秘密の情報を要請する権利との間に、深刻な構造的問題がある(existence of a serious systemic issue)、と指摘した。

２．ＳＧ協定２．１、４条及び１９９４年のＧＡＴＴ１９条に関する申立

公開版ＩＴＣ報告からの秘密の情報の削除

　ＥＣは、ＩＴＣが秘密の情報を削除したこと自体の正当性は認めるものの、秘密情報を非公開とする代わりに総計や割合についての統計データを提供すべきであったとして、ＳＧ協定２．１条、４条違反を主張した。

　パネルは次のように述べて、ＥＣの主張を退けた。①ＳＧ協定４．２（ｃ）条は、「事例の詳細な分析(detailed analysis of the case under investigation)」と「審査した要因の関連性を立証するもの(demonstration of the relevance of the factors examined)」とを公開することを求めつつ、明示的にＳＧ協定３条に言及し、ＳＧ協定３．２条に規定される「性質上秘密であるものまたは秘密のものとして提供された情報(information which is by nature confidential or which is provided on a confidential basis)」は公開されないことを予定している、②ＳＧ協定３．２条は秘密の情報の定義について詳細に規定しておらず、同条は、調査当局に何が秘密の情報かを決定する裁量を与えているものと解される、③調査当局の守秘義務に関するＳＧ協定３．２条は具体的かつ義務的である(specific and mandatory)一方、秘密の情報の要約の提供を求める規定は勧告的(hortatory)である、④業者数の少ない米国小麦グルテン国内産業において、ビジネス情報の秘密確保の重要性は非常に高いと考えられる。

輸入量の増加

　ＥＣは、ＩＴＣの輸入量の増加に関する分析は不十分かつ恣意的であったとして、ＳＧ協定２．１条に違反する、と主張した。

　パネルは、次のように述べて、ＥＣの主張を退けた。①１９９４年のＧＡＴＴ１９．１（ａ）条�及びＳＧ協定２．１条によれば、単なる輸入量の増加(increase)ではなく、重大な損害の原因もしくはおそれとなるような量での増加(in such increased quantities (absolute or relative to domestic production) as to cause or threaten serious injury、協調は原文通り)、履物ＳＧ上級委決定(DS121)に従いこれを言い換えれば、量的にも質的にも、重大な損害の原因もしくはおそれとなるほど十分に最近、突然、急激、重大でなくてはならない(the increase must be sufficiently recent, sudden, sharp and significant, both quantitatively and qualitatively, to cause or threaten to cause serious injury)、②ＩＴＣは、輸入の絶対量及び相対量の変化を調査しており、これによれば、輸入は絶対量・相対量とも調査対象期間�中盤から後半にかけて、急激かつかなりの(significant)上昇を見せており、この輸入の絶対量・相対量の増加は、最近、突然、急激、かつ重大であるとみなし得る。

重大な損害

　ＥＣは、①ＩＴＣは、ＳＧ協定４．２（ａ）条に規定された産業の状態に関連するすべての関連要因を考慮していない、②これらの要因に関するＩＴＣの決定及び結論は、根拠がない、と主張していた。

　パネルは、ＳＧ協定４．２（ａ）条に列挙されている項目は、すべて考慮しなくてはならないことを確認した上で、ＥＣの①の主張について、次のように結論した。

　パネルはまず、特に生産性(productivity)について、ＩＴＣが、産業全体の生産性(overall industry productivity)ではなく、労働者の生産性(worker productivity)のみを考慮していたとするＥＣの主張について、次のように述べて、これを退けた。(i)ＳＧ協定４．２（ａ）条は、「当該国内産業の状態に関係を有するすべての要因であって客観的なかつ数値化されたもの（all relevant factors of an objective and quantifiable nature having a bearing on the situation of that industry、強調はパネル報告原文通り）」と規定しており、ＳＧ協定４．２（ａ）条が列挙する生産性は、産業全体の生産性に言及している�と考えられる、(ii)ＩＴＣは、資本投下(capital investment)及び生産(production)に関するデータを収集・分析しており、これらのデータから単位資本あたりの生産性(productivity of capital)を割り出すことは可能であり、より統括された生産性についての審査が好ましいとはいえ、ＩＴＣの産業全体の生産性に関する審査がＳＧ協定４．２（ａ）条の要件を満たしていないとまではいえない。

　パネルは次に、ＩＴＣが損益に関して適切な説明を怠っており、ＳＧ協定４．２条に違反している、とのＥＣの主張について、次のように述べて、これを退けた。(i)ＩＴＣ報告によれば、ＩＴＣは小麦グルテン４社のうち３社について財務情報を収集しており、この３社は、小麦グルテンの国内生産の大多数(substantial majority)を占めている、(ii)ＳＧ協定は、「国内産業」が国内総生産高の「相当な部分(major proportion)」を占めている生産者によって構成されることを認めており、すべての生産者からのデータ入手が常に求められているわけではないと解される、(iii)ＩＴＣは、すべての生産者から、ユニット・バリュー(unit value)に関するデータを収集している。

　ＥＣは①の主張の中でも、とくに、ＩＴＣが、グルテン小麦生産の過程で生じる副産物などについて、それぞれ別個に収益率を計算したこと(allocation of profitability among the output products)について、単一の原材料から、単一の生産ラインを用いて生産される当該産品(the wheat gluten/wheat starch industry relies by necessity on a single raw material input(wheat or wheat flour) and utilizes a single production line)については、すべてまとめて収益率を計算すべきであり、小麦グルテンの収益率が下がっているとのＩＴＣの認定には、適切な説明がなされていない、と主張していた。パネルは、次のような理由で、ＥＣの主張を退けた。(i)ＳＧ協定は、データの収集や分析について詳細な規定はしておらず、また、収益率の分配(allocation)について特定の方法を指定していない、(ii)ＩＴＣは、収益率の分配について十分な審査を行ったと述べている、(iii)ＩＴＣが収集・分析したデータから推察しても、分配の方法が不適切だったとは考えられない。

　ＥＣは、ＳＧ協定４．２（ａ）条に列挙されていないものの、(i)調査期間中の新規参入、(ii)副産物の発展、(iii)輸入を推進する米国企業の存在、といった要因についても関連要因として考慮すべきであったと主張していた。パネルは、ＳＧ協定４．２（ａ）条に列挙されていない項目であっても、利害関係者が調査の途中で明確に指摘した関連する要因はすべて評価されなくてはならない(any other relevant “factors” – in the sense of factors that are clearly raised before them as relevant by the interested parties in the domestic investigation、強調は原文通り)が、ＳＧ協定は評価の方法自体については何も規定していない、とし、(i)～(iii)の要因に関するＩＴＣの調査は、ＳＧ協定４．２（ａ）条に違反していたとはいえない、と結論した。

　パネルは、ＥＣの上記②の主張について、次のように述べて、これを退けた。(i)「重大な損害」の認定は、国内産業の状態に関連するすべての要因に鑑み、当該産業全体の状況の評価に基づき行わなくてはならない(only on the basis of an evaluation of the overall position of the domestic industry, in light of all the relevant factors having bearing on the situation of that industry)、(ii)重大の損害の認定は、直近のデータに基づいて行わなくてはならず (any determination of serious injury must pertain to the recent past、強調は原文通り)、特に、調査期間の終了まで現在の重大な損害が認められる必要がある(we consider it essential that current serious injury be found to exist, up to and including the very end of the period of investigation、強調は原文通り)、(iii)ＩＴＣは調査期間５年間すべての傾向を考慮している、(iv)国内産業のすべての要因がマイナス傾向を示している必要はなく、全体の傾向及びその相互作用(the totality of the trends, and their interaction)を考慮して、重大な損害を認定すべきであり、重大な損害の認定に至った経緯(how)について根拠に基づく適切で合理的な説明(an adequate, reasoned and reasonable explanation)がなされておれば十分であり、ＩＴＣは本件においてそのような適切な認定を行っている。

　以上より、パネルは、ＩＴＣの重大な損害の認定がＳＧ協定４．２（ａ）条に違反していない、と結論した。

因果関係

　パネルは、履物パネル・上級委決定(DS121)を引用しつつ、輸入の増加と重大な損害との因果関係の認定に関するＳＧ協定４．２（ａ）及び（ｂ）条の要件を満たしているか否かは、次の３点を考慮して判断すべきである、とした。①輸入の上昇傾向が、損害関連要因の下降傾向と一致しているか、一致していない場合は、一致していないにもかかわらず因果関係が認められることについての根拠に基づく適切かつ合理的な説明がなされているか(whether an upward trend in imports coincides with downward trends in the injury factors, and if not, whether an adequate, reasoned and reasonable explanation is provided as to why nevertheless the data show causation)、②輸入産品と国内産品との競争条件が、輸入と損害との因果関係を表しているか(whether the conditions of competition between the imported and domestic product as analyzed demonstrate the existence of the causal link between the imports and any injury)、③その他の関連要因が考慮され、かつ、輸入以外の要因による損害を、輸入によって生じた損害とみなしていないか(whether other relevant factors have been analyzed and whether it is established that injury caused by factors other than imports has not been attributed to imports)。

　パネルは、①について、次のように述べて、ＩＴＣの因果関係の認定は、ＳＧ協定４．２条に違反していない、と結論した。(i)ＩＴＣの認定によると、調査期間中の、輸入の全体的傾向と、産業の全体的状態に関する重大な損害に関する要因の全体的傾向との間には、一般的な一致があり、ＩＴＣの因果関係を肯定する認定は支持され得る(Looking at the overall trends in imports and the overall trends in serious injury factors pertaining to the overall situation of the industry over the period of investigation, we consider that there is a general coincidence between the trends in injury factors and the trends in imports which would support a finding by the investigation authority of a causal connection between increased imports and serious injury、強調は原文通り)、②個々の損害関連要因と輸入との間に一致がない場合もわずかに存在するが、これ自体は因果関係の肯定を妨げるものではない(the existence of slight absences of coincidence in the movement of individual injury factors in relation to imports would not preclude a finding by the USITC of a causal link between increased imports and serious injury、強調は原文通り)。

　パネルは、②について、次のように述べて、ＩＴＣの認定は、ＳＧ協定４．２条に違反していない、と結論した。(i)ＳＧ協定２．１条の「そのような条件で(under such conditions)」輸入される、という文言は、ＳＧ協定４．２（ａ）及び（ｂ）条の下行うべき因果関係についての分析の実体(the substance of the causation analysis that must be performed under Article 4.2(a) and (b)、強調は原文通り)について述べたものであり、別個の義務を課すものではない、(ii)言い換えれば、輸入の増加が国内産業に与える影響の適切な評価(an adequate assessment of the impact of the increased imports at issue on the domestic industry under investigation)に基づき、輸入が増加している条件が、重大な損害の原因となるもしくはなるおそれがあるようなものなのか(whether the conditions under which increased imports are occurring are such as to cause or threaten to cause serious injury)、を審査すれば良い、(iii)ＳＧ協定２条及び４．２条は、「価格」を競争条件のひとつとして考慮すべきか否かについて何も触れておらず、「そのような条件で」という文言は、必ずしもすべてのケースで価格分析を求めるものではない、(iv)ＩＴＣは、ＳＧ協定４．２条の要件を満たす、価格分析についての適切、論理的、かつ合理的な説明を行っている。

　パネルは、③のうち、特に、その他の関連要因が考慮されたか否かについて、次のように述べ、ＩＴＣはＳＧ協定４．２（ａ）及び（ｂ）条に違反していない、と結論した。(i)調査当局は、ＳＧ協定４．２（ａ）条に列挙された要因、及び、利害関係者が関連するとして明確に指摘したその他の関連するすべての要因を評価する義務を負うが、それ以外の要因を審査するか否かについては調査当局の裁量にゆだねられており、調査当局自ら情報を収集し評価する義務はないと解される(the investigating authorities are not, in our view, obligated on their own initiative to seek out and evaluate factors other than those explicitly enumerated in Article 4.2(a) beyond those that are clearly raised before them by the interested parties in the course of the investigation、強調は原文通り)、(ii)ＩＴＣは、ＥＵ利害関係者が明確に指摘した要因については評価を行なっている、(iii)ＥＵ利害関係者が、「プロテイン・プレミアム(protein premium)（分析者注：低プロテイン小麦と高プロテイン小麦との間の価格差）」を関連する要因として明確に指摘したか否かについて当事者間に争いがあるが、提出された証拠から、ＥＵ利害関係者は、１９９３年から１９９４年のプロテイン・プレミアムの価格に与える影響(the effect of protein premiums on price)については明確に指摘しているが、ＥＣが本件で問題としている１９９４年以降の因果関係分析に関連する要因として、小麦のプロテイン・プレミアムを明確に指摘していた、とは立証されていない(the European Community has not demonstrated to us as a matter of fact that the EU producer respondents clearly raised the broader issue of wheat protein premiums as a possible relevant causal factor pertaining to the post-1994 segment of the period investigation which the European Community raises in these Panel proceedings)。

　パネルは次に、③のうち、輸入以外の要因による損害を、輸入によって生じた損害とみなしていないか否か(whether,…, the USITC satisfied the requirements in Article 4.2 (b) Safeguard Agreement to demonstrate the causal link between the increased imports and the serious injury, and not to attribute to imports injury caused by other factors)について、次のように述べ、ＩＴＣがＳＧ協定４．２（ｂ）条に違反していたと結論した。(i)ＳＧ協定４．２（ａ）及び（ｂ）条は、問題となっている市場の条件下で、輸入の増加が、それ自体で、重大な損害の原因になっていることを立証するよう求めている(require that a Member demonstrate that the increased imports, under the conditions extant in the marketplace, in and of themselves, cause serious injury、強調は原文通り)、言い換えれば、輸入の増加は、それ自体で、ＳＧ協定の「重大な」という要件を満たすに十分な損害の原因となっていなくてはならない(the increased imports must be sufficient, in and of themselves, to cause injury which achieves the threshold of “serious” as defined in the Agreement)、(ii)(i)の要件を満たすための具体的な方法については、ＳＧ協定は特に規定していないが、調査当局が用いる方法は、輸入の増加による損害が「重大な」損害であることを確実にするものではならない(the method it selects must ensure that the injury caused by increased imports, considered alone, is “serious” injury)、(iii)ＩＴＣは、損害の原因と考えられるその他の要因を複数考慮しているが、そのうちの国内産業全体の稼働率及び生産能力拡大(capacity utilization and increased capacity)が損害の原因の一つとなっていることを認めつつ、輸入の増加ほどには重要な原因ではない(neither domestic competition nor increased domestic capacity was a more important cause of serious injury than increased imports、強調はパネル本文)と結論しているが、ある要因が、重大な損害の発生に関し、輸入と同じもしくは輸入以上の原因とはなっていないからといって、そのような要因が重大な損害に全く関係ないということにはならない(A demonstration that a given causal factor did not make an equal or greater contribution to serious injury than imports does not demonstrate that such factor made no contribution at all to serious injury、強調は原文通り)、(iv)ＩＴＣの因果関係に関する分析は、輸入がそれ自体で国内産業に対する重大な損害の原因となるほどのもので、他の要因による損害を輸入による損害とみなさないよう確保するものではない(the USITC’s causation analysis does not ensure that imports, in and of themselves, are sufficient to cause serious injury to the domestic industry once injury caused by other factors is not attributed to imports)、

　以上のように、パネルは、①及び②については、ＩＴＣは１９９４年のＧＡＴＴ１９．１（ａ）条、ＳＧ協定２．１、４．２条に違反していないと結論したが、③については、ＩＴＣはＳＧ協定４．２（ｂ）条に違反していると結論した。

一部の国からの輸入に対するＳＧ措置不適用

　ＩＴＣは、すべての原産地からの小麦グルテン輸入について損害及び因果関係分析を行った(a “global” investigation concerning injury and causation that included imports of wheat gluten from all sources, regardless of their origin)後、ＮＡＦＴＡ８０２条に基づき、カナダからの輸入が輸入全体に占める割合、及び、カナダからの輸入が重大な損害の原因となっている度合いを審査し(a separate and subsequent examination of whether imports from Canada accounted for a substantial share of total imports, and whether imports from Canada contributed importantly to the serious injury caused by imports)、カナダからの輸入が輸入全体に占める割合は高いものの、カナダからの輸入は重大な損害の主要な原因とはなっていないとして、カナダからの輸入に対してはＳＧ措置を適用しないと決定した。ＥＣは、これに対し、１９９４年のＧＡＴＴ１９．１条、ＳＧ協定２．１、４．２条などの違反を主張した。

　パネルは、ＳＧ協定２．１条及び４．２条の意味について、次のように述べた。①ＳＧ協定２．１条及び４．２条の文言は、調査の対象となった輸入産品の範囲は、措置の対象となる輸入産品と対称していなくてはならない(a requirement of symmetry between the scope of the imported products subject to the investigation and the scope of the imported products subject to the application of the measure)、すなわち、調査の対象産品と措置対象産品は同じ(same)でなくてはならない、と規定していると考えられる、②ＳＧ協定４．２（ａ）条、２．２条からも、以上の見解は支持される、③履物ＳＧ(DS121)上級委も、同趣旨の決定をしている。

　パネルは、本件におけるＩＴＣのアプローチについて、次
